So many results that aren't mine?

Abstract:

İhtiyati tedbirin etkin olabilmesi ve tedbirden beklenen yararın sağlanabilmesi için Hukuk Muhakemeleri Kanunu’nda yer verilen ihtiyati tedbire muhalefetin cezasına ilişkin düzenleme, Kanun’un 398. maddesinde yer almaktadır. İhtiyati tedbire muhalefete ve bunun yaptırımına dair düzenleme incelenirken, maddi unsur kapsamında, tedbire muhalefeti gerçekleştirebilecek kişiler, tedbire muhalefetin konusu ve ilgili fiil ele alınmalıdır. Bu kapsamda söz konusu düzenleme Hukuk Muhakemeleri Kanunu’nda yer almakta olsa dahi, ceza hukukuna dair prensipler çerçevesinde değerlendirilmelidir.
