Mut‘a nikâhının, cahiliyye döneminden İslâm’a intikal etmiş bir evlilik çeşidi olduğu hususunda İslâm uleması arasında ittifak vardır. Ancak bu evliliğin İslâm’ın tasarrufu ile kazandığı nihai hükmün ne olduğu konusunda Sünnî ve Şiî uleması arasında ihtilaf bulunmaktadır. Sünnî kaynaklara göre mut‘a nikâhı İslâm’ın ilk dönemlerinde uygulanmış olmasına rağmen daha sonra Hz. Peygamber tarafından kıyamet gününe kadar yasaklanmıştır. Şiî İmâmiye kaynaklarında ise bu nikâh türünün Hz. Peygamber tarafından hiçbir zaman yasaklanmadığı hatta süresiz evlilikle eş değer olduğu sadedinde yoğun bilgiler yer almaktadır. Bu çalışmada öncelikle mut‘a nikâhının her iki gelenekteki hükmünün dayanakları incelenmektedir. Bu bağlamda son dönemde Sünnî ve Şiî düşünceyi temsil eden müfessirlerden İbn Âşûr ile Tabâtabâî’nin konu hakkındaki görüşleri incelenerek ortaya koydukları deliller sıhhat açısından tahlil edilmektedir. Tespit edebildiğimiz kadarıyla, İbn Âşûr’dan önce -Sahâbe dönemini istisna ederek- mut‘a nikâhının zaruret hallerinde bile caiz olduğunu ifade eden bir Sünnî âlim bulunmamaktadır. Ancak İbn Âşûr, bu nikâhın, savaş, gurbet, yolculuk gibi zaruret hallerinde caiz olduğu görüşünü savunmaktadır. Böylece Sünnî-Şiî uleması arasında bir problem olan Mut‘a nikâhı, İbn Âşûr’un söz konusu yaklaşımıyla birlikte Sünnî ulema içerisinde de bir tartışma konusuna dönüşmektedir. İmâmiyye’nin muteber kaynaklarında Mut‘a nikâhının yasaklandığına hatta zina ile eşdeğer olduğuna dair pek çok sahih rivayet bulunmaktadır. Ancak bu rivayetler, inançlarıyla bağdaşmadığından Şiî uleması tarafından çoğunlukla görmezden gelinmiştir. Tabâtabâî de bu rivayetler hakkında sessiz kalmayı tercih ederken Sünnî kaynaklarda geçen mut‘a nikâhının yasaklandığına dair onlarca rivayeti ise çürütmeye çalışmaktadır. Diğer Şiî ulemadan farklı olarak Tabâtabâî, mut‘a nikâhının, günümüz şartlarında zina başta olmak üzere birçok gayri meşru cinsel birlikteliklerin önüne geçilmesi açısından bulunmaz bir alternatif ve lütuf olduğunu savunmaktadır.
There is an alliance between the Islamic glory as marriage is a sort of marriage that has been invaded to Islam from the time of ignorance. But there is a dispute between the Sunnite and the Shiite Ulema about what the final judgment that this marriage is winning with the saving of Islam. According to the Sunni sources, the marriage to Mut was applied in the early periods of Islam, but later Hz. The Prophet (peace and blessings of Allah be upon him) was forbidden until the Day of Resurrection. This is the source of this kind of marriage. The prophet has never prohibited it, even the same value as the permanent marriage. In this study, first of all, the foundations of the judgment of both traditions of marriage to mut are examined. In this context, in the last period of the Sunni and Shi’i thought represented by the inspectors of Ibn Aşûr and Tabâtabâi’s opinions on the subject, the evidence they show is evaluated from the healthiest point of view. As far as we can find, there is no Sunni âlem that expresses that the marriage of Muth, except the Sahâbe period before Ibn A’shûr, is even in the case of harshness. But Ibn ‘Ashur defends that this marriage, war, gurt, and travel is caused in the circumstances of harshness. Therefore, the marriage of Mut, which is a problem between the Sunni-Shia ulema, with the subject approach of Ibn Ashur, becomes a matter of discussion within the Sunni ulema. There are many genuine righteousness in the muteber sources that the marriage to Mut is prohibited even equal to zina. But these righteous righteousness are often ignored by the Shi’i ulema because they do not match their beliefs.
