Abstract:

In recent years, the opinion that the rigorous practices of business law that have been effective throughout the world should be flexible in our country has also been responded and the various flexible work practices have been incorporated into our business legislation with the Law No. 4857. One of these, the remote work model at first didn’t find enough area of application, and therefore it took many years even to remove the regulations provided for in the Labour Act. However, the measures to be taken to combat the Covid-19 epidemic, which emerged from 2019 and is increasingly spread throughout the world, have negatively affected work on the workplace and made it clear the importance of remote work. Public and private sector workplaces that want to reduce the effects of inflamed disease on work life have largely moved to work on a distance. In this case, the subject needs to be examined in detail. In our prepared work on this need, we have been trying to reveal the situation of remote workers in the field of employment and social security law. In this direction, it was first focused on the concept of remote work; on the other hand, it was studied the rights and obligations that our business legislation recognizes to the remote workers and the circumstances that show the characteristics of the employees’ insurance.
