Klasik fıkıh kitaplarında suçlar, şâri‘ tarafından cezası belirlenmiş olup olmadığı ve suçun çeşidini de dikkate alan had, kısas ve ta‘zîr suçları ve cezaları şeklinde tasnif edilmektedir. Had suçları Allah hakkı olarak yerine getirilmesi gereken, miktar ve keyfiyeti nasla belirlenmiş cezaî müeyyideleri ifade eder. Kısas suçu, şahısların hayat ve vücut bütünlüğüne karşı yapılan haksız saldırı sonucu oluşur. Bu suçlar kasten işlenirse öngörülen asli ceza kısastır ve bu şâri‘ tarafından belirlenmiştir. Ta‘zîr suçları, şâri‘ tarafından hakkında belirlenmiş bir ceza müeyyidesi olmayan, had ve kısas suçları dışında kalan, miktarı ve uygulaması yasama organına veya belli ölçüler dahilinde takdiri hakime bırakılmış Allah veya kul hakkını ihlal eden hukuka aykırı fiillere denir. Hile (aldatma-dolandırıcılık) eylemleri İslam ceza hukukunda ta‘zîr suçları kapsamında değerlendirildiği gibi İslam hukukunun büyük ölçüde tatbik edildiği Osmanlı ceza hukukunda da ta‘zîr suçları içerisinde değerlendirilmektedir. Osmanlı hukukunda hile suçlarını çoğunlukla kalpazanlık, sahte evrak düzenlemek ve esnafın yiyecek maddeleri ile alakalı aldatma eylemleri oluşturmaktadır. Çoğunlukla alışveriş işlemlerinde karşılaşılan bu suç tipleri insanların aldanmasına yol açtığı ve ticari faaliyetlerde olmazsa olmaz kabul edilen karşılıklı güven duygusunu zedelediği ve haksız kazançlara yol açtığı için İslam ceza hukukunda bu suçun faillerine çoğunlukla ta‘zîr cezası olan dayak cezası uygulanmaktadır. Ancak Osmanlı’da benzer suçları işleyen faillere, Osmanlı ceza hukukunun yazılı kaynakları kabul edilen fetva mecmuaları, kanunname maddeleri ve mahkeme defterlerinde gördüğümüz üzere suçun, suçlunun vasfı ve suça etkili olan haller de dikkate alınarak hafif-ağır çeşitli ta‘zîr yaptırımları uygulanmaktadır. Osmanlı hukuk uygulamalarında suçlulara siyaseten katl, organ kesme, kürek, hapis, kalebentlik, pranga, sürgün, dayak, teşhir, meslekten ihraç, azil, müsadere ve para cezaları gibi çeşitli ta‘zîr yaptırımları icra edilmektedir. In the classical fiction books, crimes are classified in the form of crimes and punishments which are determined by the sharia and which take into account the variety of crimes. The wrongdoers of Allah shall be fulfilled as the right, the amount and the enjoyment of what is determined by the punishment. The short crime is the result of an unfair attack on the life and body integrity of individuals. If these crimes are deliberately committed, the original punishment is short and determined by this sharia. The punishment of Ta'zîr is called the unlawful facts that violate the right of Allah or the right of the servant, which are not a punishment of a punishment determined by the Shari, which remained except for the had and short crimes, the amount and the application of the law or the judge in certain measures. Thus, in the Islamic Criminal Law, the actions of fraud are considered to be in the scope of the crimes of the Islamic Criminal Law, as well as in the Ottoman Criminal Law, where the Islamic Criminal Law is largely practiced, as well as in the crimes of the Islamic Criminal Law. In the Ottoman law, fraud crimes are mostly formed by misconduct, fake documents and fraud related to the foods of the trade. These types of crimes that are often encountered in shopping processes lead to the deception of people and, if not in commercial activities, the sense of mutual confidence that is recognized and causes unfair profits, the Islamic Criminal Law applies the punishment, which is mostly the punishment of the crimes. But to the criminals who committed similar crimes in Ottoman, the written sources of Ottoman criminal law are accepted fetva mandates, the laws and court records, as we see in the cases of the crime, the defendant's defendant and the crime is effective, and light and heavy various punishments are applied, taking into account.
