In sensitive areas of public life in Turkish law there are some of the independent regulatory agencies. As a result of re-regulation of the field of masscommunications, competence, banking etc., Turkish IRA’s was founded as an impartial public legal entity that had broader competences and responsibilities. On the one hand we should respect freedoms of consumers and on the other hand State should regulate public order. Access to the internet also one of the subsubject of public order. Main actor that regulate and supervise of internet is Information and Communications Authority (BTK). ICA has been critisized that not being independent and impartial against to Government. As a basic constitutional freedom guard structure, ICA should be as much as autonomous. If Body act as an organic part of government, it creates the impression as a censor device. We discussed in this presentation ban of access to internet and their legal results
