In terms of Constitutional Law, restriction and suspension of fundamental rights is possible under certain conditions. Restriction and suspension are separate concepts conditions and results differ. Although the restriction of the property right is frequently discussed, suspension the use of the property right is an issue that has not been brought up much. Because a state of emergency is necessary for the suspension of fundamental rights. The state of emergency is not a common situation in the ordinary course of life. However, it is possible to happen. For this reason, the article will deal with the suspension of the right to property. The preferred method is literature review and compilation of law articles. In the content of the article, the decisions of the Constitutional Court and the European Court of Human Rights will be used, together with the articles and theses on the subject. Within the scope of the article, first of all, the limitation and suspension of fundamental rights will be discussed. In this way, it is aimed to better understand the differences by explaining the nature of both institutions. Then, the right of ownership and its scope will be discussed, and finally, the concept of stopping the right of ownership will be mentioned.
