The emotional relationship in between a man and a woman who intend to marry each other finds its statutory construction under the instituti.on of "Engagement". Despite its limited legal consequences, this union is legally accepted and regulated by Turkish Civil Code, due to its highly rated social acceptance. Engagement i.s a family law contact that concludes with the mutual marriage promise. Engaged parties are deemed to build trust related to the realization of the marriage not only on the other party and but alsa on some people closely related to the other party. Both the conclusion and the termination of the engagement contract are relatively uncomplicated. But the breach of the promise within this simpl.e structure leads to the fall through of the marriage and accordingly bars the achievement of the goal by the enga.gement contract. This situation alsa constitutes the betrayal of the trust that has been built by the enga.gement. According to the provisions of TCC Art. 120, the party, which terminates the engagement for convenience or by fault, is obliged to compensate the pecuniary damages of not only the other party but alsa the parents of other party and others pretend to be parents. Under the principl.e of goodfaith, this compensation liability covers the pecuniary loss caused by the breach of trust related to the realization of the marriage.
