Kınalızâde Ali Çelebi (ö. 979/1572), birçok medresede müderrislik yapmış ve merkezî beldelerde kadılık görevlerini ic etmiş Osmanlı döneminin önde gelen âlimlerindendir. İslâmî ilimlerin farklı alanlarında telif etmiş olduğu eserlerinin neredeyse tamamı günümüze ulaşmış ve önemli kısmı neşredilmiştir. Ayrıca hayatı, eserleri ve ilmi görüşleri hakkında birçok ilmi çalışmalar yapılmıştır. Bir fıkıh âlimi olarak Kınalızâde’nin eser verdiği alanlardan birisi de fıkhî çalışmalarıdır. Fıkhın tabakât ve fürû konularının ele alındığı eserlerinden bir kısmı incelenerek yayımlanmış iken, bir kısmı da günümüze ulaşmış olup yazma nüshaları kütüphanelerde kayıtlı bulunmaktadır. Kınalızâde’nin fıkhın önemli bahislerinden olan gasp konusunun bazı meselelerini gündeme getirdiği eserlerinden birisi ise Risâle fi’l-gasb adlı risâlesidir. Yaklaşık bir buçuk varaklık Arapça olarak yazılmış küçük hacimli bu risâlenin şimdiye kadar tespit edilebilen tek nüshası Süleymaniye Kütüphanesi, Süleymaniye Koleksiyonu 708 numarada kayıtlıdır. Risâlede esasen Bürhâneddîn el-Mergînânî’nin (ö. 593/1197) Hidâye adlı eserinde belirttiği gasp konusunun tarifi değerlendirmeye tabi tutulurken, gasp konusunun fürû fıkhın diğer konuları arasındaki sıralaması da gündeme getirilmektedir. Buna göre Kınalızâde’nin yazma halindeki risâlesinin neşredilerek ilim camiasına kazandırılmasının katkı sağlayacağı düşünülürken, risâlede dile getirilen konuların incelenerek tahlil edilmesi, Risâle fi’l-gasb çerçevesinde de olsa Kınalızâde’nin fıkhi müktesebatı ve konumunun anlaşılması önem arz etmektedir.
