Dolandırıcılık suçu, 5237 sayılı Türk Ceza Kanunu’nda “Kişilere Karşı Suçlar” arasında “Malvarlığına Karşı Suçlar” başlığı altında 157 ila 159. maddeler arasında düzenlenmiştir. Bu suç malvarlığına karşı işlenen suçların tipik örneğini oluşturmaktadır ve günümüzde en çok işlenen suçların başında gelmektedir. Bununla birlikte bilişim teknolojisindeki gelişmelerin etkisiyle, dolandırıcılık suçu son yıllarda akla gelmeyecek yöntemlerle işlenir hale gelmiş bu ise, neredeyse herkesin bu suçun mağduru olabilme ihtimalini güçlendirmiştir. Gerçekten de bilişim sistemlerinin hayatın birçok alanında kullanılması, hem dolandırıcılara daha geniş bir hareket alanı yaratmakta hem de en açıkgözlü kişilerin dahi bu suçun mağduru olabilmesine imkân tanımaktadır. Suçun işlenişini kolaylaştırdığından, dolandırıcılığın bilişim sistemlerinin araç olarak kullanılması suretiyle işlenmesi TCK m.158/1-f’de ağırlaştırıcı neden olarak öngörülmüştür.
The crime of fraud, in the Turkish Criminal Code No. 5237, is regulated between "crimes against persons" under the title "crimes against property" between Articles 157 and 159. This crime is a typical example of crimes committed against property and is among the most committed crimes today. However, with the influence of the developments in the information technology, fraud crime has become processed in the last few years in unreasonable ways, which has increased the likelihood that almost everyone can be the victim of this crime. Indeed, the use of computer systems in many areas of life both creates a wider sphere of movement for fraudsters and makes it possible for even the most obvious people to be the victims of this crime. Since the crime facilitates the processing, the processing of fraud by means of the use of computer systems as a vehicle is predicted as an aggravating cause in TCK m.158/1-f.

Using information systems as a tool facilitates comitting fraud, therefore, it has been stipulated as an aggravating cause in Turkish Penal Code art.158 / 1-f.
