Bu çalışmanın konusu kasten öldürme suçunun iki nitelikli şeklini oluşturan, TCK m. 82/1-h ve i’de düzenlenen bir suçu gizlemek, delillerini ortadan kaldırmak veya işlenmesini kolaylaştırmak ya da yakalanmamak amacıyla öldürme ile bir suçu işleyememekten duyulan infialle öldürmedir. Çalışmada öncelikle bir başka suçla kasten öldürme suçu arasındaki ilişki belirlenmeye çalışılmıştır. Bir başka suç dolayısıyla işlenen öldürmenin daha fazla cezalandırılmasının nedenleri açıklanmaya gayret edilmiştir. Ayrıca kasten öldürmenin işlenmesinin nedeni olan bir başka suçtan ne anlaşılması gerektiği ortaya konulmuştur. Özellikle gizleme amacıyla öldürmede gizleme amacının soruşturma ve kovuşturmadan kurtulmak için mi yoksa itibar kaybı, mesleki, sosyal, ekonomik dezavantajlardan korunmak gibi başka nedenleri de kapsayıp kapsamadığı konusuna değinilmiştir. Keza bir başka suç nedeniyle işlenen kasten öldürme suçunun olası kastla veya ihmali davranışla işlenip işlenemeyeceği gibi konular ele alınmıştır. Bir suçun işlenmesini kolaylaştırmak için öldürmenin bir suçu gizlemek amacıyla öldürmeden farkı açıklanmaya çalışılmıştır. Bir suçu işleyememekten duyulan infialle öldürme nitelikli halinin şartları, özellikleri incelenmiştir.

The subject of this study consists of two qualified forms of willful murder. These are TCK art. In the study, first of all, the relationship between another crime and the crime of willful murder was tried to be determined. An effort has been made to explain the reasons for the higher punishment of murder committed in due to another crime. In addition, it has been revealed what should be understood from another crime, which is the reason for willful murder. In particular, in murder for the purpose of concealing a crime, has been mentioned whether the purpose of concealment is to avoid investigation and prosecution, or whether it covers other reasons such as loss of reputation, protection from professional, social and economic disadvantages. Likewise, issues such as willful murder committed due to another crime whether can be committed with eventual intent or negligent behavior are discussed. It has been tried to explain the difference between murder in order to facilitate the commission of a crime and murder in order to hide a crime. The conditions and characteristics of the state of murder with indignation from not being able to commit a crime are been examined.
