Kentsel alanlarda imar planları ile oluşturulmak istenen imar parsellerinin inorganik yapısı ile organik dokulu mülkiyet örüntüsünün örtüşmemesi sorunsalına üretilen çözüm yollarından biri de bitişik parsellerin birleştirilerek imar parseli haline dönüştürülmesidir. Bu çalışmada parsellerin tevhidine ilişkin yasal mevzuat ve yargı kararları somut örnekler ışığında incelenmiş ve sonucunda ortaya çıkan sorunların geleneksel çözüm yolları yanında seçenek çözüm önerilerine yönelik mekanizmalar tanıtılmıştır. Yeni önerilerin uygulamaya geçmesi halinde uyuşmazlıklara neden olan ve çoğu kez yargıya intikal eden bu problemin daha kolay çözülebileceği öngörülmektedir. Öte yandan çalışmanın bir adım ötesinde bu konuya ilişkin yapılacak çalışmalarda bu makalede öngörülmüş olan iş akış diyagramından esinlenerek yasal mevzuatın yeniden düzenlenmesinin yararlı olacağı önerilmektedir. Ayrıca konu ile ilgili araştırma yapacaklara, ombudsmanlık kurumunun tanımlanan iş akışında yerinin araştırılması önerilebilir.
Implementary zoning plan is one of the tools in the name of creating urban areas. In some special cases, this plan may make it possible to allow the construction permit of the plot to be consolidated with the other plot. This is mostly due to the provision of minimum parcel square (both length and width) and no more parcels within the zoning block. In this study, the legislative and judicial decisions concerning the incorporation of parcels are examined in the light of real examples. In this study, besides the traditional solutions of emerging problems, mechanisms for suggesting alternative solutions are introduced. It is expected that if the proposals are put into practice with this study, these problems that cause conflict and often pass to the judicial can be solved more easily. On the other hand, it is proposed that for the studies to be carried out one step beyond the study, it would be beneficial to reorganize the legal legislation inspired by the workflow diagram provided in this article. In addition, if they are to conduct research on the subject, it may be advisable to investigate the location of the ombudsman institution in the identified workflow.
