1879 tarihli Ceza Muhakemesi Kanunu (Usul-i Muhakemat-ı Cezaiye Kanun-u Muvakkatı), Osmanlı döneminde kabul edilmekle birlikte Cumhuriyet döneminde de uygulanmış olan, Türkiye’nin ilk ceza muhakemesi kanunudur. 1808 tarihli Fransız Ceza Muhakemesi Kanunu esas alınarak hazırlanan kanun, bir başlangıç bölümünün yanı sıra iki kitaptan oluşmaktadır. Bu çalışmanın birinci kısmında, 1879 tarihli Ceza Muhakemesi Kanunu’nun kanunlaşma sürecinin tarihi ve hukuki arka planı, mehaz 1808 tarihli Fransız Ceza Muhakemesi Kanunu’nun özellikleri, iki kanunun karşılaştırılması ve 1879 tarihli kanunun ceza muhakemesi hukuku tarihi bakımından önemi ele alınmaktadır. İkinci kısımda ise kanunun sistematiği ve kapsamı, Kanunun Osmanlı-Türk ceza muhakemesi hukukuna getirdiği savcılık, sorgu hâkimliği, kanun yolları, ceza mahkemeleri gibi bazı esaslı yenilikler ile benimsediği ceza muhakemesi hukuku sistemi incelenmektedir.
The Criminal Procedure Act of 1879 (Usul-i Muhakemat-i Cezaiye Act-u Muvakkatı) was the first Criminal Procedure Act of Turkey, which was adopted during the Ottoman period and was also applied during the Republic period. Based on the French Criminal Procedure Act of 1808, the law consists of a first part and two books. The first part of this study discusses the history and legal background of the legislation process of the Criminal Procedure Act of 1879, the characteristics of the French Criminal Procedure Act of 1808, the comparison of the two laws and the importance of the Criminal Procedure Act of 1879. In the second part, the system and scope of the law is examined, the law brought to the Ottoman-Turkish criminal trial law, the prosecutor's jurisdiction, the legal pathways, the criminal courts, the criminal trial law system adopted with some basic innovations, such as the prosecutor's jurisdiction, the prosecutor's jurisdiction, the prosecutor's jurisdiction.
