Kırdan kente göç eden insanlar, kentte yaşamaya başladıkları andan itibaren kente ait değer ve kurallara hayatlarında yer verirler, bu kentli olmanın gereğidir. Kentler, sakinlerine, sosyal, ekonomik, kültürel, fiziki bakımdan bir çok imkanlar sunar. Kent sakinleri gündelik yaşamları içerisinde bu imkanlardan faydalanırken, birbirlerine ve çevreye karşı sosyal kurallar ve davranış kalıplarını benimseyip uygulamak zorundadır. Kentsel yaşamın, tüm bu gereklilikleri, kentsel hak kavramının, temelini oluşturur. Ayrıca, tüm bireylerin sağlıklı bir çevrede yaşama ve barınma hakları vardır. Bu haklar konut hakkı olarak ifade edilir. Sosyal devlet anlayışında ekonomik bakımdan güçsüz ve zayıf olanların, insan onuruna yakışır bir biçimde yaşamlarını sürdürebilmeleri için devlet tarafından desteklenmeleri ve korunmaları söz konusudur. En temel insan haklarından olan yaşam hakkının, korunması ve sağlanması için konut hakkının devlet tarafından güvence altına alınması gereklidir. Türkiye’de, doğrudan kenti ve kentlileri korumaya yönelik yasal düzenlemeler bulunmamakta, var olan hukuki metinlerin içerisinde kısmen ve dolaylı koruma sağlayan hükümler bulunmaktadır. Kentsel bir hak olarak görülen, “konut hakkı”, ise Türk anayasal metinlerinde, yaşam hakkının bir parçası olarak görülerek, korunmakta ve desteklenmektedir. Cumhuriyetin kuruluşundan günümüze kadar, özellikle alt ve orta gelir grubuna mensup, ekonomik bakımdan imkansızlıkları bulunan vatandaşlar, sosyal devlet anlayışının gereği olarak, barınma ve sağlıklı bir çevrede yaşamlarını sürdürebilmeleri için uygulanan politikalar ile imkanlar ölçüsünde her dönem desteklenmiştir.
People who migrate from the countryside to the city, from the moment they start living in the city, adopt the values and rules of the city in their lives, this is the necessity of being urban residents. Cities offer their residents many social, economic, cultural and physical opportunities. While city residents benefit from these opportunities in their daily lives, they have to adopt and apply social rules and behavior patterns towards each other and the environment. All these requirements of urban life form the basis of the concept of urban rights. In addition, all individuals have the right to live and shelter in a healthy environment. These rights are expressed as housing rights. In the concept of the social state, those who are economically weak and poor should be supported and protected by the state in order for them to survive in a way which is worthy of human dignity. In order to protect and ensure the right to life, which is one of the most fundamental human rights, the right to housing must be guaranteed by the state. In Turkey, there are no direct regulations to protect the citizens of the town and there are provisions that provide partial and indirect protection in the existing legal texts. “The right to housing”, which is seen as an urban right, is protected and supported in Turkish constitutional texts as a part of the right to life. Since the foundation of the Republic, especially the citizens of low and middle-income groups who have economic impossibilities, have been supported in every period to the extent possible with the policies implemented to enable them to live in a shelter and a healthy environment, as required by the concept of the social state.
