Bağdat Şâfiî hukukçusu İstahrî’nin (ö. 328/940), hayatına yer verilen tabakât kaynaklarında başta fürû-ı fıkıh sahasında olmak üzere birden fazla eser telif ettiği belirtilse de kendisinden ictihâdî görüşlerini ihtiva eden derli toplu bir kitap –görüldüğü kadarıyla- tespit edilememiştir.Ancak şu kadarı var ki onun söz konusu ictihâdî görüşlerine Şâfiî mezhebinin birçok kaynağında yer verildiğine rastlanmaktadır. İstahrî, Râfiî el-Kazvînî (ö. 623/1226) ve Nevevî (ö. 676/1277) tarafından mezhepte müftâ bih kabul edilen görüşlere ekseriyetle muvafık kalsa da bazı meselelerde mezhebe muhalif farklı görüşler ileri sürdüğü görülmektedir. İstahrî’nin mezhebe büyük zenginlik kazandıran farklı görüşleri, -her ne kadar Şâfiî fukahası tarafından tenkite tabi tutulsa da- ictihâd açısından dikkate değer görülmüş ve İstahrî’nin görüşleri sonraki dönemlerde kaleme alınan birçok Şâfiî fıkıh eserlerinde zikredilmiştir. Bu çalışmada, Şâfiî müctehid sıralamasında “ashâbü’l-vücûh/müctehid fi’l-mezheb” kategorisinde değerlendirilen İstahrî’nin hayatı, eğitimi ve telifâtı gibi bir takım bilgilere kısaca değindikten sonra aile hukuku ekseninde mezhebe muhalif bazı görüşleri ele alınacaktır. Söz konusu çalışmayla İstahrî’yi müntesibi olduğu mezhebe muhalefet etmeye sevk eden sâikler tespit edilerek onun fıkhî yönü ortaya konulacaktır.
Although it is stated that the Baghdad Shafi'i jurist Istahri (d. 328/940) wrote more than one work, especially in the field of fiqh, in his biography works, which include his life, a compact book containing his ijtihad views could not be identified -as far as it seems. Although Istahri mostly agrees with the views accepted as fundamental in the madhhab by Rafi al-Kazvini (d. 623/1226) and Nevevi (d. 676/1277), it is seen that he put forward different views on some issues. Istahri's different views, which brought great wealth to the sect, were considered remarkable in terms of ijtihâd, although they were criticized by the Shafi'i scholars, and Istahri's views were mentioned in many Shafi'i fiqh works written in later periods. In this study, after briefly mentioning some information such as Istahri's life, education and copyright, which is evaluated in the category of "ashâbü'l-wücûh / muctehid fi'l-madhhab" in the order of Shafi'i mujtahid, some of his opinions against the sect in the axis of family law will be discussed. With the study in question, the motives that led Istahri to oppose the sect he is a follower of will be determined and his fiqh aspect will be revealed.
