Niyâbet bir terim olarak, hukukî konularda başkası adına tasarrufta bulunma veya başka birinin yerine herhangi bir ibadeti edâ veya kaza etme anlamlarına gelmektedir. Bu bağlamda hadîs kaynaklarında başkası adına tasaddukta bulunma, köle azat etme, hac yapma, vefat etmiş bir kimsenin nezirde bulunup da edâ etmediği namaz, oruç, yürüme, i’tikâf vb. ibadetleri kaza etme rivâyetleri nakledilmiştir. Bu konuların bazısında niyâbet ittifakla kabul edilmişken, bazı meselelerde ise muhaddislerce sahih kabul edilen hadîslerin varlığına rağmen ihtilâf edilmiştir. İhtilaf edilen mevzulardan birisi de başkasının yerine hac yapmadır. Bu konudaki niyâbet rivâyetleri, yaşayan ve vefat eden kişi için hac yapma şeklinde vârid olmuştur. Bu çalışmamızda, bu ihtilâfın hicrî ilk üç asırda rivâyetler üzerinden nasıl başladığı, sahâbe ve tabiînin âlimlerinin nasıl bir tutum takındıkları, bu dönemlerde hangi rivâyetlerin aktarıldığı ve özellikle hicrî ikinci asır mezhep imâmlarının bu hadîslere nasıl yaklaştıkları ve ne kadarını bildikleri ortaya konulmaya çalışılacaktır. Çalışmamızda da görüleceği üzere her hadîs aynı şöhreti yakalayamamış, bütün ilim meclislerinde aynı zaman dilimlerinde var olamamış, bazıları ise senedleri sahih de olsa pek fazla itibar görmemiştir.
