6098 sayılı Türk Borçlar Kanunu’nun özel borç ilişkileri başlığı altında düzenlenen kira sözleşmelerinin ikinci ayırımında konut ve çatılı iş yeri kiralarına özgü maddelere yer verilmiştir. Konut ve çatılı iş yerlerine ilişkin kira sözleşmeleri genel hükümlerde belirtilen sebeplerle sona erebileceği gibi kiraya verenden ya da kiracıdan kaynaklanan sebeplerle bildirim veya dava yoluyla sona erebilir. Kiraya verenden kaynaklanan sebeplerle konut ve çatılı işyeri kiralarının dava yoluyla sona erme halleri TBK 350 ile 351. maddelerde düzenlenmiştir. Kiraya verenin ve yakınlarının gereksinimleri sebebiyle kira sözleşmesinin sona ermesi TBK 350. maddenin ilk fıkrasında düzenlenmiştir. TBK 350. maddesinin ilk fıkrası ile kiraya veren tarafından kendisi, eşi, altsoyu, üstsoyu ve kanun gereği bakmakla yükümlü olduğu diğer kişilerin konut veya işyeri ihtiyacı oluştuğunda tahliye davası açılarak kiracıyı tahliye edebileceği düzenlenmiştir. Çalışmamızda kiraya verenin ve kanunda belirtilen diğer kişilerin gereksinimleri, konut ihtiyacı bakımından incelenmiş olup ihtiyacın samimi, zorunlu olması hususu doktrin ve Yargıtay kararları göz önünde bulundurularak incelenmiştir.
In the second section of the rental contracts held under the title of private debt relations of the Turkish Debt Act No. 6098, property and roof workplace rental special items were included. The rental contracts relating to housing and roofing workplaces may be terminated for reasons specified in the general provisions, as well as for reasons arising from the tenant or the tenant, by means of notification or proceedings. For reasons arising from the tenant, the case of termination of housing and roof workplace rentals through the case is regulated in Articles 350 and 351 of TBK. The termination of the rental contract due to the demands of the rental owner and his relatives was arranged in the first subparagraph of Article 350 of the TBK. by TBK 350. With the first paragraph of the article, it is arranged that the tenant can withdraw the tenant by opening the evacuation case when the residence or workplace is needed by the other persons who are obliged to care according to the law, his wife, subsequent, superior and other persons who are obliged to care according to law. The demands of the tenant and other persons specified in the law in our work have been examined in terms of housing needs and the doctrine and the judgment of the court on the fact that the need is intimate and mandatory have been examined.
