Abstract:

Under the terms of pleasure, sales forms a special type of sales contract. This agreement was not included as a name in Law No. 818 on Debts. The Turkish Debt Act No. 6098 provides a detailed provision. The condition of pleasure, the sale, helps to make sure the buyer’s decision on whether to buy or not the goods before all aspects of the contract are formed. The contract of sale, with the preference conditions that are quite common in the application, was also included in the Roman law, especially with the name pactum displaycentiae. In the study, the contract was also examined in connection with this institution.

Sales contract with the condition of appreciation is a special type of sale contract. This contract is not included in the Code of Obligations No. 818. However, it is stipulated in detail in the Turkish Code of Obligations No. 6098. Sales contract with the condition of appreciation helps to finalize his/her decision on whether or not to buy the goods before buying with the terms of tuning. The sales contract with the condition of appreciation, which is quite common in practice, was also included in Roman Law under the name of pactum displecentiae especially. In this study, the contract was examined in connection with this institution.
