Abstract:

The crime of suicide is regulated in Article 84 of the Turkish Criminal Code. There are three different types of criminal offences that have different elements. In the first joke, the facts of suicide incitement, encouragement, strengthening the suicide decision of someone else and helping someone else to suicide in any way are linked to punishment. In the third chapter, the incentive to suicide and in the fourth chapter, the incentive to suicide and the forcing to suicide are sanctioned. In this study, the subject will be investigated of these types of crimes, which are organized within the same article but have different elements and characteristics. Disadvantages in the regulation technique of the matter can lead to a number of problems in the application in the context of this type of crime. In particular, our study aims to identify the problematic points relating to the aforementioned types of crimes, to bring suggestions for solutions to the problems arising from the perspective of law, which should be given examples of the doctrine of the discussions and the practice of justice.
