Ülkemizde gelişen tarihsel süreç içerisinde tıpkı diğer ülkelerde de olduğu gibi birçok hükümet sisteminin varlığı söz konusu olmuştur. Osmanlı imparatorluğu ile başlayan bu süreç Cumhuriyet tarihine kadar olan zaman diliminde monarşi, meşruti monarşi, parlamenter sistem ve başkanlık sistemlerinin sıralandığı hükümet sistemlerinin varlığı ile donatılmıştır. Ülkemizde oldukça uzun bir dönem uygulanan parlamenter hükümet sistemi siyasi krizlere yol açarak eleştirilere sebep olmuştur. Siyaset gündemi içerisinde bu eleştirilere çözüm olarak Başkanlık hükümet sisteminin varlığı sık sık dile getirilmiş ve yapılan 2017 Anayasa değişikliği sonucunda parlamenter hükümet sistemi terk edilerek Cumhurbaşkanlığı Hükümet Sistemi’ne geçilmiştir. Cumhurbaşkanlığı Hükümet Sistemi ile yasama, yürütme ve yargı alanında köklü değişiklikler gerçekleştirilmiş, Cumhurbaşkanlığı kararnameleri aracılığıyla yapılan yeni düzenlemelerle yönetimde istikrar ve verimliliğin arttırılması amaçlanmıştır. Literatür incelemesi yöntemine dayanılarak yapılan bu çalışmanın temel amacı hükümet sistemi değişikliği neticesinde yapılan değişikliklerin idari teşkilat üzerindeki etkilerini incelemek ve kuvvetler ayrılığı ilkesi bağlamında değerlendirmektir. Çalışmada elde edilen temel bulgu; Cumhurbaşkanlığı Hükümet Sistemi’nde yapılan bazı değişikliklerin kuvvetler ayrılığına aykırılık teşkil etmesi ve Cumhurbaşkanlığı kararnamelerinin asli nitelikte bir düzenleyici işlem olmasına rağmen sınırlarının net bir şekilde belirlenmemiş olmasıdır. Bu bağlamda Anayasa değişikliği neticesinde yeniden düzenlenen yasama yürütme ve yargı organlarının yapı ve işleyişinde aksaklığa sebep olan sorunların ortadan kaldırılması gerekmektedir.
There have been many government systems in the historical process that has developed in Turkey, like in other state administrations in the world. This process, which started with the Ottoman Empire, showed itself with the existence of government systems in the time period until the Republic, in which monarchy, constitutional monarchy, parliamentary system and presidential systems were manifested itself. The parliamentary government system, which has been implemented for a long time in our country, has been subjected to serious criticism due to many reasons such as the failure of the governments to receive a vote of confidence in addition to the coalition periods that led to political crises. The Presidency Government System was frequently asserted as a solution to these criticisms in the political agenda. As a result of the 2017 Constitutional amendment, the Parliamentary Government System was abandoned, and the Presidential Government System was adopted. With the Presidential Government System, radical changes were made in the legislative, executive, and judicial fields, and it was aimed to increase the stability and efficiency in the administration with the new regulations made through the Presidential decrees. The main purpose of this study, which is based on the literature review method, is to examine the effects of the changes made because of the government system change on the administrative organization and to evaluate them in the context of the principle of separation of powers. In this context, the main finding obtained in the study is that since the Presidential Government System is not a system that emerged after a sufficiently long planning, the new constitutions created are contrary to the separation of powers in some respects, and although the Presidential decrees are a fundamental regulatory process, their borders are clearly defined is not determined. It is necessary to eliminate the problems that cause disruption in the structure and functioning of the legislative, executive, and judicial organs, which were reorganized as a result of the constitutional amendment.
