Çocukların cinsel istismarı suçu, Türk Ceza Kanunu’nun “cinsel dokunulmazlığa karşı suçlar” başlıklı bölümünde 103. maddede düzenlenmektedir. Çalışmada öncelikle bu suç ile korunan hukuksal değer ardından suçun unsurları analiz edilmiş ve bu çerçevede maddi unsurlar, manevi unsurlar ve hukuka aykırılık unsuru öğretideki tartışmalar ve yargı kararları ile birlikte incelenmiştir. Bundan sonra cinsel davranışın sarkıntılık düzeyinde kalması ve suçun vücuda organ veya sair cisim sokmak suretiyle işlenmesi ve diğer nitelikli unsurlarına değinilmiş, daha sonra kusurluluk ile ilgili önem arz eden hususlar irdelenmiştir. Ardından suçun temel ve nitelikli unsurlarına teşebbüs ve gönüllü vazgeçme, iştirak ve içtima konularına yer verilmiştir. Son olarak yaptırım, muhakeme, dava zamanaşımı ve infaza ilişkin özellik arz eden hususlar değerlendirme konusu yapılmıştır. Cinsel istismar suçuna ilişkin belirtilen bu hususlar doktrindeki tartışmalar ve yargı kararları ışığında, Alman hukukundaki benzer düzenlemelere değinilerek incelenmiştir.
The crime of sexual abuse of children is regulated in Article 103 of the Turkish Criminal Code, entitled "crimes against sexual harassment". The study first analyzed the legal value protected by this crime and then the elements of the crime, and in this framework the material elements, the spiritual elements and the element of law-controlling were studied along with discussions in the doctrine and judgment decisions. After that, the sexual behavior remains at the level of abuse and the crime is processed by entering an organ or body in the body and other qualifying elements are referred to, then the issues that are of importance with regard to deformity. Then the basic and qualifying elements of the crime were placed in the subjects of attempt and voluntary withdrawal, participation and intrusion. Finally, the punishment, the trial, the time of proceedings and the characteristics of the execution were assessed. These facts referred to in the crime of sexual abuse have been examined in light of the doctrine discussions and judgments, referring to similar regulations in German law.
