Abstract:

In recent years, as in the world, the concept of child crime has gained great importance in Turkey. In addition to the development of preventive services by investigating the causes that are effective in the detriment of children, the development and strengthening of child-friendly justice for children who have been detrimented and faced with the criminal justice system has been concerned. In the framework of child-friendly justice, the Children’s Protection Act No. 5395 and the Children’s Crime Causes “in the environment in which the child is in” are assessed in order to ensure the assessment of the children’s Crime Causes. The social investigation reports study the interaction with all the systems in which the child is associated with the individual characteristics, identify the risks that will negatively affect the child’s healthy development along with the strong aspects, and prepare preventive and therapeutic intervention plans to address these risks, aimed at ensuring andining the healthy development of the child. In this context, social investigation reports, which are an effective element to prevent the repeat of criminal behavior, are also used as an important tool for the assessment of the child’s criminal liability. The concept of child criminal liability has been studied within the framework of national and international legislation and aims to contribute to the assessment of criminal liability in the social investigation reports prepared by social services experts.
