Abstract:

Bu makalede Osmanlı/Türk köy idaresi sisteminin Fransa’dan iktibas edilip edilmediği sorunu incelenmektedir. Bu sorunu çözmek amacıyla, bir yandan 1864 ve 1871 Osmanlı Vilayet Nizamnamelerinin köy idaresine ilişkin hükümleri ile 5 Mayıs 1855 tarihli Fransız Kanununun hükümleri, diğer yandan da 18 Mart 1924 tarihli Köy Kanununun hükümleri ile 5 Nisan 1884 tarihli Fransız Kanununun hükümleri arasında karşılaştırma yapılmıştır. Karşılaştırma sonucunda Fransız ve Osmanlı/Türk köy idaresi sistemleri arasında, organların oluşumları ve görev ve yetkileri bakımından benzerliklerin olduğu gözlemlenmiş ve Osmanlı/Türk köy idaresi sisteminin, farklı yanları olmakla birlikte, Fransız sisteminden esinlendiği sonucuna ulaşılmıştır.

Abstract:

This article examines the question of whether the Ottoman/Turkish system of village administration is taken from the French system. In order to solve this problem, on the one hand the provisions of the Ottoman Municipal Law of 1864 and 1871 concerning village administration are compared with the French Law of 5 May 1855 on Municipal Administration, and on the other hand the Turkish Village Law of 18 March 1924 with the French Law of 5 April 1884 on Municipal Administration. It is observed that there are many similarities between the Ottoman/Turkish and French systems of village/commun administration in terms of the formations of the organs and their duties and powers, and it is concluded that the Ottoman/Turkish system of village is inspired by the French system.
