Abstract:

The bankruptcy delay institution, despite its long-term use in our legal system, has arisen many problems during its implementation. As a result, the Concordato institution, which has been in our legal system for many years, but has almost never been used, and with the law on amendments to some laws, the bankruptcy delay has been removed and removed, has begun to be reapplicated. In contrast to the bankruptcy delay, the concordato institution in which the maximum time in the trial is determined, the recipient party has gained more right of speech and the debtor is controlled has become more functional. The Concordato institution is a reorganization procedure that provides the possibility that financial or legal persons with disruption can get rid of the situation in which they are and continue their business life, which is determined by the agreements between the debtor and the recipient and the approval of this agreement by the court. This study included general information about the recipients meeting, which has an important function in the concordato institution, which is currently being effectively used by many, and then the scope, functioning, legislation size, the results and the facts influenced by the concordato project under separate titles. However, the stages of the recipients meeting, the place in the concordato institution, the legal provisions that must be followed in practice have been discussed. The study identified the problems that may arise in the implementation of the recipients meeting, which has an important role in the concordato institution, and the solutions proposals for these problems were presented and solutions proposals were presented in order to contribute to the relevant area.
