Kanun koyucu genel olarak hukuki işlemlerde zayıf olan tarafı koruma eğiliminde olup genel işlem koşulları söz konusu olduğunda da 6098 sayılı Türk Borçlar Kanunu’nun 20 ila 25. maddelerinde çeşitli denetimler öngörmüştür. İş hukukunda özel olarak genel iş koşullarına özgü denetim hükümleri öngörülmemiştir. İşbu makalede Türk Borçlar Kanunu’nun ilgili hükümlerinin, genel iş koşullarının denetimi için de uygulanması gerektiği olgusu açıklanmaktadır. Makalede öncelikle çalışma kapsamını anlamlandırmak amacıyla kısaca genel işlem koşullarının unsurlarına yer verilmiş, akabinde genel iş koşulları kavramı unsurları ile birlikte incelenmiş, genel iş koşullarının türleri değerlendirilmiş, son olarak da genel iş koşullarının Türk Borçlar Kanunu kapsamında yürürlük, yorum ve içerik denetimi doktrin ve yargı kararları ışığında incelenmiştir.
The lawmaker generally tends to protect the party that is weak in legal processes and when it comes to the general transaction conditions, it has provided various audits in Articles 20 to 25 of the Turkish Debt Act No. 6098. There are no specific regulations for the general business conditions in the business law. This article explains the fact that the relevant provisions of the Turkish Debt Act should also be applied to the supervision of general working conditions. In the article first, in order to understand the scope of work, the elements of the general business conditions were briefly included, then the general business conditions were studied together with the elements of the concept, the types of general business conditions were evaluated, and finally the general business conditions were studied in the light of the doctrine and judicial decisions of the applicability, comments and content control within the framework of the Turkish Debt Act.
