Çalışmanın anlamlanabilmesi için öncelikle takas kavramı, takas kavramının hukukî niteliği ve işlevi, benzer müesseselerden farklılıkları ve takasın farkları ve çeşitleri üzerinde durulmuştur. Çalışmanın devamında, takasın şartları ve kullanılması ise iki kısma ayrılarak olumlu ve olumsuz şartlar başlığı altında incelenmiştir. Çalışmanın son kısmında ise takasın hukukî sonuçları üzerinde durulmuştur. Çalışma ele alınırken, Yargıtay’ın konu ile ilgili TBK*’nın yürürlüğe girmesinden sonraki güncel kararları da çalışmada ilgili kısımlarda yer almıştır.

In the course of the study, the conditions and application of setoff has been analysed as being divided into two parts under the headings as “affirmative” and “adverse” conditions. In the concluding section of the study, the legal results of the set-off have been concluded. By analysing the issues, the decions of the court of appeal have been mentioned which were given after the Turkish Code of Obligations has been come into effect.
