Yasal süreçlerde dil kullanımı, adli dilbilimin en temel inceleme konularından birisi olsa da Türkçe bilimsel yazında bu konuda yapılmış çalışma sayısı oldukça azdır. Bunun bir nedeni adli dilbilimin Türkiye’de henüz kısa bir süredir çalışılması, diğer bir nedeni ise gerçek adli veriye erişimde yaşanılan zorluklardır. Bu çalışma ile Türk Ceza Kanunu’nun 102 ve 103. maddelerinde tanımlı cinsel saldırı ve çocuğun cinsel istismarı suçlamalarıyla yargılanan sanıkların mahkemede vermiş oldukları ifadeler üzerinde altsözce çözümlemesi yapılarak, ifade bölümlerindeki iletişimsel amaçların tespit edilmesi ve bu amaçlara ilişkin nitel bulguların ortaya çıkarılması hedeflenmiştir. Açık kaynaktan elde edilen veri üzerinde yakın okuma ile gerçekleştirilen çalışma neticesinde beş farklı altsözcenin varlığı tespit edilmiş; bunlar kabul etme, reddetme, hafifletme, sempati ve suçlama olarak adlandırılmıştır. Altsözcelerin içeriği ve görünümlerine ilişkin bilgiler, bu adları taşıyan başlıklar altında sunulmuştur. Bulguların, gelecekte hem özgül biçimde bu konuda hem de genel olarak (betimleyici) adli dilbilim bağlamında yapılabilecek ileri çalışmalara dair umut verici olduğu görülmüştür.
Even though the language in the legal process is one of the major subjects of forensic linguistics, there are only a few studies in this regard in the scientific literature of the Turkish language. One of the reasons is that forensic linguistics has recently become a subject for study in Turkey, and the other reason is the hardship of accessing real forensic data. This study aimed to detect communicative purposes of statement parts and to reveal qualitative findings on these purposes by analysing moves of statements given by defendants in court who were accused of sexual assault and child sexual abuse, which were defined under articles 102 and 103 of the Turkish Criminal Code. At the end of the study, which was conducted on data from an open-source by close reading, five different moves were identified and named as acknowledgement, denial, palliation, sympathy, and accusation. Information regarding moves’ content and prospects was presented under subtitles with these names. Findings seem to be promising for further studies in the future in terms of both this specific topic and (descriptive) forensic linguistics in general.
