Oturma hakkının sahibine sağladığı yetkiler, hakkın kapsamı dahilinde kullanılır. Türk Medeni Kanunu’nun 824/I. maddesi uyarınca oturma hakkının kapsamı, genel olarak hak sahibinin kişisel ihtiyaçları doğrultusunda belirlenir. Hak sahibinin kişisel ihtiyaçları ise oturma hakkı tesis edildikten sonra değişebilir. Bu nedenle başlangıçtaki kişisel ihtiyaçların sonradan değişikliğe uğraması, oturma hakkının kapsamına da etki eder. Ayrıca hak sahibinin kişisel ihtiyaçları her zaman bir sınırlamaya tabi olmaksızın oturma hakkının kapsamını belirlemez; zira taraflarca ya da kanunen getirilen sınırlamalar söz konusu olabilir. Oturma hakkı münhasıran kişiye bağlı bir haktır; hak bütünüyle ya da kullanım hakkı başkasına devredilemez. Bununla birlikte Türk Medeni Kanunu’nun 824/II. maddesi, aksine bir düzenleme olmadıkça hak sahibinin ailesi veya ev halkının hak sahibiyle birlikte oturmasına imkân tanımıştır. “Aile ve ev halkı” kavramlarının geniş veya dar yorumlanması sonucunda hak sahibiyle birlikte bu haktan faydalanan kişiler tespit edilerek oturma hakkı sayesinde verilen yetkinin kapsamı belirlenir. Hakkın tesis edildiği yerin fiziksel koşulları da hak sahibiyle birlikte oturabilecek olan kişileri sınırlandırır. Türk Medeni Kanunu’nun 824/III. maddesi uyarınca oturma hakkının binanın bir bölümü üzerinde tesis edilmesi halinde, hakkın kapsamına ortaklaşa kullanılan yerlerin de dahil edilmiş olur. Bu doğrultuda, oturma hakkının kapsamının belirlenmesinde, ortaklaşa alanların tespiti önem kazanır.
The powers granted to the owner of the right of habitation are used within the scope of this right. As per to article 824/I of Turkish Civil Code, the scope of the right of habitation is generally determined in line with the personal needs of the right holder. The personal needs of the right holder may change after the establishment of the right of habitation. For this reason, changes in the initial personal needs also affect the scope of the right of habitation. In addition, the personal needs of the right holder do not always determine the scope of the right of habitation without any limitations as there may be restrictions imposed by the parties or by law. The right of habitation is an exclusively personal right; the right of habitation as a whole or only the right of use cannot be transferred to third parties. However, article 824/II of Turkish Civil Code allows family members or household to reside with the beneficiary unless otherwise agreed. By determining the content of the “family and household” concepts with a broad or narrow interpretation, the persons who benefit from this right with the right holder are determined and the scope of the authority given by the right of habitation is clarified. The physical conditions of the place where the right is established also limit the persons who can reside with the right holder. According to article 824/III of the Turkish Civil Code, if the right of habitation is established on a part of the building, it is understood that the scope of the right includes the places used jointly. In this direction, the determination of common areas gains importance in determining the scope of the right of habitation.
