Abstract:

This study deals with fourteen non-Muslims (Christian and Jewish) foundation that also observes the benefit of the Fukarâ-i Muslim. The "anti-foundations" that stand in a different place among countless non-Muslim foundation, for the first time in literature, are held light with this work. Five of them are the greatest, and nine are the greatest, and nine are the greatest. The founders of the foundation are: Aikile? by bt. Toma (Rum) and Nikolaki v. Shahin (Rum). The work consists of two sections. The first part will discuss the legal background that allows non-Muslims to establish a foundation in terms of creating a historical foundation, and the place and development of these foundation in the Islamic and Ottoman history will be examined retrospectively. The opinions of Sheikhullah Ebussuud Efendi, who has given a legal ground to the non-Muslim foundation in Ottoman, will also be discussed in this context. In the second section, fourteen foundations will be examined, the corresponding foundations and copies of the documents will be given at the end of the work. With the clarification of the details concerning these foundations, it is hoped that any religious affiliations will come to an explanation on topics such as the transition and the foundation culture that exist between them.
