Bu çalışmanın amacı, Mâlikîler’in istihsan anlayışını ana hatlarıyla ortaya koymak suretiyle usûl konularında yapılacak olan çalışmalara farklı bir bakış açısı getirmektir. İslâm hukuk usûlünde istihsan, kıyasın katılığını ortadan kaldıran ve çoğunlukla genel hükümden istisna yapmayı gerektiren şer’î bir delildir. Hanefîlerden sonra bu delili en çok kullanan ekol Mâlikî mezhebidir. Ancak onların istihsan anlayışlarının yeterince ortaya konulmuş olduğunu söyleyemeyiz. Bu çalışmada kronolojik bir metot takip ederek öncelikle Mâlikîlerde istihsan anlayışının gelişim ve kavramlaşma süreci ortaya konulacak, daha sonra istihsanın mahiyeti ve çeşitleri hakkındaki bilgiler analiz edilerek bir sonuca varmaya çalışılmıştır. Çalışmamızın ana kaynakları başta Şâtıbî olmak üzere Mâlikîlerin eserleri olacaktır. Bunun yanı sıra Mâlikîlerin fıkıh anlayışı üzerine yapılan bazı çalışlarla, usûl-i fıkıh alanında yazılan bazı eserlere de müracaat edilmiştir. Mâlikî istihsanının anlaşılması için zaman zaman Hanefîlerin istihsan anlayışıyla bazı mukayeseler yapılmış ve bu vesileyle ikisi arasındaki benzerliklere ve farklılıklara dikkat çekilmiştir.
The purpose of this study is to bring a different perspective on the work that will be done in the processes by showing the understanding of the Mâlikîles' intelligence with their main lines.
