3568 sayılı Serbest Muhasebeci Mali Müşavirlik ve Yeminli Mali Müşavirlik Kanunu ile 5018 sayılı Kamu Mali Yönetimi ve Kontrol Kanunu’na tabi personelin mali sorumlulukları incelendiğinde özünde kamu kaynağının azaltılmasına dayandırıldığı görülmektedir. Her iki meslek grubunun da kamu kaynağının azaltılması ortak paydasında buluşan sorumluluklarından hareketle sorumluluk müessesinin karşılaştırılabileceği değerlendirilmiştir. Çalışmanın amacı; 3568 sayılı Serbest Muhasebeci Mali Müşavirlik ve Yeminli Mali Müşavirlik Kanunu ile 5018 sayılı Kamu Mali Yönetimi ve Kontrol Kanununa tabi meslek mensuplarının mali sorumluluklarının mevzuat ve yargı kararları yardımıyla karşılaştırılmasıdır. Bu doğrultuda; yargı kararları taranarak “mali sorumluluk” özelinde emsal kararlar derlenmiş ve bahsi geçen meslek mensuplarının mevzuat karşısındaki durumu mukayeseli olarak ortaya konulmaya çalışılmıştır.
According to the Law No. 3568 on Free Accountants and the Law No. 5018 on Public Financial Management and Control, the financial responsibilities of the staff are examined in the essence of the reduction of public resources. It is also estimated that the reduction of public resources of both professional groups can be compared with the responsibility of the committee in the joint share of responsibilities. The objective of the study is to compare the financial responsibilities of the professional members under the Public Financial Management and Control Act No. 5018 with the help of legislative and judicial decisions. In this regard, the judgment has been scaned by the "money responsibility" specialty and the situation of the mentioned professional members against the legislation has been tried to be compared.
