The advance care directive is regulated by art. 360-369 of the Swiss Civil Code. According to art. 360 para. 1 of the Swiss Civil Code, a person with capacity to act may instruct a natural person or legal entity to take responsibility for his or her personal care or the management of his or her assets or to act as his or her legal agent in the event that he or she is no longer capable of judgement. The advance care directive is subject to the suspensive condition of the judgement inability of the client. The appointee shall represent the client in accordance with the advance care directive and fulfil his or her obligations under the provisions of the Code of Obligations on agency contracts. The advance care directive is an important regulation in terms of self determination right. In view of demographic changes in society, it is expected that “the advance care directive” will become important also for Turkish law
