6098 sayılı yeni Türk Borçlar Kanunu, kira konusu taşınmazların el değiştirmesi yahut sınırlı aynî haklarla kayıtlanması durumunda kiracının sahip olduğu haklara ilişkin devrimsel değişiklikler getirmiştir. Buna göre, TBK.m.310 hükmü uyarınca kira sözleşmesinin kurulmasından sonra kiralananın herhangi bir sebeple el değiştirmesi durumunda, yeni malikin kira sözleşmesinin tarafı olacağı hükme bağlanmıştır. TBK.m.312 ise kira hakkının şerhini düzenlemekte olup, şayet kira hakkı şerh edilirse, yeni mâlikin kiracıya karşı ihtiyaç sebebiyle tahliye dâvası dahi açamayacağı belirtilmiştir. Bu nedenle çalışmada, böyle bir kira hakkının ne şekilde kurulduğunun, hukukî niteliğinin, kuvvetinin ve şerh edilmesinden doğacak sonuçların değerlendirilmesi ihtiyacı hâsıl olmuştur. Çalışmada anılan hususlara, teknik çerçevede açıklık getirilmeye gayret edilmiştir.
The new Turkish Code of Obligations (Code nmb. 6098) established the revolutionary changes about tenant's rights when a rented property has been sold to a third person. According to the Turkish Code of Obligations (Article 310), when a rented property sold to a third person (to a new owner) for any reason after the lease contract, the contractual rights will automatically belong to this new owner. Article 312 regulates the annotiation of lease contract. According to this regulation, if the lease contract has been annotiate to Turkish Land Registry, the new host can not file to a tenant about eviction of tenancy. Therefore, a need for evaluation is born about what the legal charter of such a lease is. This study aims to make a technical explanation of the above - mentioned points.
