Bu makale, hukuk sosyolojisi bağlamında bir inceleme olarak değerlendirilebilir. Asırları kaplayan tarihi sürece sahip bir hukuk sisteminin doğru anlaşılması için onun tarihi, coğrafik, sosyolojik arka plandan bağımsız incelenemeyeceği tabiidir. En azından bu unsurları dikkate alan çalışmaların daha aydınlatıcı olacağı söylenebilir. Bu araştırmada, sosyal koşulların önemli oranda değişiklik arz ettiği dönemlerde fıkıh usulünde farklı görüşlerin ortaya çıktığı tezi savunulmaktadır. Makalede iki farklı dönem incelenecektir. Bunlardan birincisi, Moğol istilası ve Endülüs’ün işgalinin yaşandığı zaman dilimidir. Diğeri ise, modern çağlardır. Bu iki farklı zaman diliminde İslam coğrafyasının olağanüstü koşullar yaşadığı ve bunun neticesinde usulde farklı görüşlerin ortaya çıktığı görülmektedir.
This article can be considered as an examination in the context of legal sociology. It is natural that a legal system that has a historical process that covers the centuries can not be studied independently of its historical, geographical, sociological background to be properly understood. It can be said that at least the studies that take into account these elements will be more illuminating. In this study, the thesis is supported that different opinions arise in the philosophy in the periods in which social conditions bring about significant changes. In this article, two different periods will be examined. The first of them is the time period when the Mongol invasion and the Indulus occupation occurred. The other is the modern age. In these two different periods of time, it appears that Islamic geography has experienced extraordinary conditions and as a result, different opinions arise in the procedure.
