Abstract:

Anayasa Mahkemesinin 1982 Anayasası’nda “Yargı” Bölümünde “Yüksek Mahkemeler” baslıgı altında ilk organ olarak düzenlenmesi onun Anayasamızdaki konumu üzerindeki tartısmalara son vermemistir. Özellikle Anayasa Mahkemesinin esas islevinin niteligi, yasaların anayasaya uygunlugunun denetimini gerçeklestirmek, onu “genel mahkemeler” içinde degerlendirmemizi mümkün kılmamaktadır. Diger yandan, Anayasa Mahkemesinin kamu erkleri karsısındaki pozisyonu ve Anayasa’da aynı baslık altında yer alan Yüksek Mahkemelerle iliskileri dikkate alındıgında onun orada düzenlenen yüksek yargı organları gibi bir “Yüksek Mahkeme” olarak tasavvur edilmesinin mümkün olamayacagı yargısı daha da kuvvet kazanmaktadır. Bu nedenle Anayasa Mahkemesinin özel bir statüye sahip anayasal organlarımızdan biri olarak nitelendirilmesi daha yerindedir.

The Constitutional Court’s “constitutional Position”

Abstract:

The establishment of the Constitutional Court as the first body under the pressure of the "Higher Courts" in the 1982 Constitutional Court's "Jour" section does not end the disputes on its position in our Constitution. Specifically, the nature of the basic function of the Constitutional Court, the realisation of the control of the conformity of the laws to the constitution, does not make it possible for us to distort it into the "general courts". Diger, on the one hand, takes into account the position of the Constitutional Court in front of the public clauses and the relations with the High Court under the same pressure in the Constitution, the judgment becomes even more strong that it will not be possible to be described as a "High Court" such as the high judicial bodies organized there. Therefore, it is more appropriate to qualify the Constitutional Court as one of our constitutional bodies with a special status.
