İdarenin mali sorumluluğu öncelikle ve asli olarak kusurlu, ikincil olarak kusursuz sorumluluğa dayanmaktadır. Kusursuz sorumluluk, kamu külfetleri karşısında eşitlik ilkesi ve risk ilkesi olmak üzere çoğunlukla iki ana ilke kapsamında incelenmektedir. Ancak Danıştay’ın okul alanlarında meydana gelen zararlar için kusursuz sorumluluğa dayanarak son yıllarda vermiş olduğu bazı kararları klasik kusursuz sorumluluk ilkelerine uymamaktadır. Bu kararlarda gösterilen gerek kusursuz sorumluluk dayanağı gerekse koşulları yerleşik kusursuz sorumluluk ilkelerine göre farklılıklar içermektedir. Biz bu çalışmada, önce Danıştay’ın bu kararlarının dökümünü yaparak dayandığı kusursuz sorumluluk şartlarını ortaya koymaya çalıştık. Ardından yeni sayılabilecek bu içtihadın farklı bir kusursuz sorumluluk türü mü sayılacağı, yoksa nasıl bir başlık altında kusursuz sorumluluk ilkelerine eklenebileceği sorularına cevap bulmaya uğraştık.
The financial responsibility of the administration is based primarily and primarily on defective, primarily on perfect responsibility. Perfect responsibility is often studied within the framework of two main principles, the equality and the risk principle against the public sectors. However, some of the decisions that the Council has made in recent years, based on the perfect responsibility for damages in the school areas, are not in accordance with the classic principles of perfect responsibility. The need to be found in these decisions must be based on perfect responsibility, and the conditions include differences according to the principles of perfect responsibility. In this study, we tried to reveal the perfect conditions of responsibility that the Council based on making these decisions. Then we tried to find answers to the questions whether this new beverage would be a different type of perfect responsibility, or how under a title it could be added to the principles of perfect responsibility.
As it is known, the pecuniary liability of the administration is firstly based on fault and secondly without fault. The faultless liability of administration is mostly divided into two main sections: the principle of risk and the principle of equal apportionment of public burdens. However, in recent years, there have been some decisions of the Council of State about faultless liability of administration at school areas which are different from classical faultless liability principles. In these decisions, conditions and the main reasons of the faultless liability differed from settled conditions of the faultless liabilitiy of administration. In this study, firstly, we want to show these decisions of the Council of State and find out the conditions of faultless liability. Then we try to find an answer about this case law whether it is similar to faultless liability like other principles of faultless liability or if it is a new sort of faultless liability of administration.
