Abstract:

Public procurement is a concept that has gained importance in the internal market order of the European Union. The European Union, which aims to prevent Member States’ national reflection on public procurement, is trying to control this area through a series of secondary legislation. Public procurement, which has a very serious importance and importance in the economies of the European Union and the world countries, also shows a decisive character in the matters in which healthcare is seen. The health care that is not directly within the jurisdiction of the European Union and its institutions is the responsibility of the Member States. However, the procurement procedures relating to health services are in interaction with the EU public procurement legislation. In this regard, the EU public procurement rules have an inevitable impact on healthcare services. The aim of the study is to demonstrate this impact and the relationship between the EU public procurement rules and the healthcare services of the Member States. The basic rule is that the healthcare provider is able to sign a contract with a public authority and the EU rules relating to public procurement must be applied. Given the great diversity of health care systems in the Member States, it is quite difficult to answer the question of how the EU’s rules on public procurement affect health care organizations in the Member States. It is also very problematic that the European Union’s public procurement rules are subject to one-type application in the field of healthcare. The study found that health care services were not in accordance with the EU public procurement rules due to differences in the organization and financing of national health systems in the Member States.
