So many results that aren't mine?

Abstract:

İşyerinin bir işverenden bir başkasına devri halinde çalışan işçilerin kıdem tazminatı hakkı açısından ne gibi hukuki sonuçlar doğacaktır? 1475 sayılı İş Kanununda bu konuyu doğrudan düzenleyen özel bir hüküm yoktur. Bununla beraber acaba konuyla dolaylı ilgisi bulunan bazı hükümlerden yararlanarak bu soruya yanıt vermek mümkün müdür? Ayrıca yargı kararları bu sorun hakkında ne gibi hükümler getirmektedir? İşte bu makalede amaç, yukarıda belirtilen bu sorulara yanıt aramaktır. Yaptığımız inceleme nihayetinde vardığımız sonuç, işçilerin hizmet akitlerinin işyerinin devri ve işverenin değişmesi halinde devam ettiği yolundadır. Bu durumda kıdem tazminatı hakkı da doğmayacaktır. Bu sonuç modem iş hukukunun anlayışına da uygundur. Ayrıca Yargıtayın son kararları da bu yoldadır.

there is no special provisions that directly regulate this topic in the business law 1475, which will be able to respond to this question by using some provisions that have been indirect interest in the subject of a employer to another, in terms of the right of the senior compensation of workers who are working in terms of the right of the senior compensation, in this article, the purpose of this article is to seek answers to these questions mentioned above, the result we finally have in the way that the workers continue in the change of the workplace and the employer, in this case the right of the senior compensation will not be the final opinion of this business law
