Abstract:

Law on Protection of Cheque Holders and Regulation of Payments by Cheques. 3167 that was enacted in 1985 has been remarkably amended with the Law No. 4814 dated 26.2.2003. The most remarkable amendment in Law No. 3167 was on Article 16 of the respective Law and while before the amendment, those who issued dud cheques were sentenced to imprisonment; it was proposed that those who issued dud cheques were to be fined in total amount dud cheque. As an exception the rule, it was proposed that those who committed the same crime for several times would be sentenced to imprisonment. Law No. 4814 not only changed the punishment of the crime but also regulated the issue in regard to doer, right to complain and delaying interest. In this study, the rationale of amendment with Law No. 4814 shall be specified and a brief evaluation shall be made. Afterwards, the crime of issuing dub cheques shall be examined within the framework of "Law on Protection Of Cheque Holders and Regulation Of Payments By Cheques" No. 317 amended with the Law No. 4814 is. During the analysis, there will be comparisons between the situation before the amendment and draft prepared in 2001.
