Aile hukukundan kaynaklanan hukuki sorunların kendine has bazı özellikleri vardır çünkü toplumun temel direği olan aile kavramı hukuki, psikolojik ve sosyal yönlerden oluşmaktadır. Aile arabuluculuğu, aile hukukunun ihtiyaçlarına cevap verebilecek bir alternatif uyuşmazlık çözüm yöntemidir. Fransa’da aile arabuluculuğu sivil toplum örgütlerinin inisiyatifi sayesinde kurulmuştur. Aile arabuluculuğunun yasal çerçevesi 2000’li yıllarda oluşturulmuştur ve bugün aile arabuluculuğu mesleği Fransız yargı sistemine tamamen entegre olmuş durumdadır. Fransız aile arabuluculuğu sistemi Avrupa’da önemli bir modeldir. Bununla birlikte bu sistemin etkinliği hâlâ tartışmaya açık durumdadır. Bu nedenle bu sistemin daha iyi anlaşılabilmesi için avantajları ve dezavantajlarının incelenmesi gerekmektedir.
