Uluslararası Deniz Hukuku Mahkemesi 1982 Birleşmiş Milletler Deniz Hukuku Sözleşmesi ile kurulmuş bir yargı organıdır. Mahkeme kurulduğundan itibaren birçok ihtiyati tedbir talebini karara bağlamıştır. Mahkemenin ihtiyati tedbir yetkisinin esası BMDHS’nin 290. maddesine dayanmaktadır. Bunun yanı sıra, BMDHS, Mahkeme’ye olağanüstü ihtiyati tedbir yetkisi vermiştir. Bu yetkisi ile Mahkeme uyuşmazlığın görüleceği yargı yeri olmamasına rağmen ihtiyati tedbire karar verebilir. Bunlara ek olarak başka sözleşmelerle de Mahkemeye ihtiyati tedbir yetkisi verilmiştir. Ve yine sözleşmede mahkemenin hükmetmesine gerek olmayan kendiliğinden doğan ihtiyati tedbirler konulmuştur. Bu kapsam da makalede öncelikle Mahkemenin BMDHS’den ve diğer Sözleşmelerden doğan ihtiyati tedbir yetkisi belirlenecek, resen doğan ihtiyati tedbirlerden söz edilip ihtiyati tedbirlerin hükmedilmesi, değiştirilmesi ve ortadan kaldırılması incelenecektir. Böylelikle UDHM’nin ihtiyati tedbir yetkisine ilişkin genel bir çerçeve ortaya konulacaktır

Abstract:

The International Court of Maritime Law is a judicial body established by the United Nations Maritime Law Convention in 1982. Since the establishment of the court, many warning measures have been filed. The jurisdiction of the court to take precautions is based on Article 290 of the BMDHS. In addition, BMDHS has authorized the Court to take extraordinary precautions. With this jurisdiction, the court may decide to take precautionary measures, although there is no court place where the dispute will be seen. In addition to these, other contracts have also been granted the jurisdiction of caution to the court. And again, the contract has made precautionary measures that are not necessary for the judgment of the court. This scope will also in this article first determine the jurisdiction of the Court for warning measures arising from the BMDHS and other Conventions, discussing the warning measures arising from the residence and examining the determination, modification and elimination of warning measures. Thus, a general framework on the authority of the UDHM to take precautionary measures will be presented
