Çalışmamız 6098 sayılı Türk Borçlar Kanunu ile tüm sözleşmelerde uygulama alanı bulan genel işlem koşullarının kişilik hakkı kapsamında de-ğerlendirilmesine ilişkindir. Kural olarak sözleşme tarafları sözleşme hü- kümlerini belirlemede özgür olsalar da sözleşme özgürlüğünün sınırlandırıl- dığı durumlar mevcuttur. Bu sınırlar arasında yerini alan genel işlem koşulları, bir sözleşme yapılırken düzenleyenin, ileride çok sayıda benzer sözleşme- de kullanmak üzere, önceden ve tek başına hazırladığı ve karşı tarafa sunduğu sözleşme hükümleri olarak tanımlanmaktadır. Sözleşme özgürlüğünün bir diğer sınırı ise kişilik hakkı tarafından çizilmektedir. Taraflar, sözleşme hü- kümleri ile birbirlerinin kişilik hakkını ihlal edemezler. Bir sözleşmede yer alan hüküm, taraflardan birinin kişilik hakkını ihlal ederken aynı zamanda genel işlem koşulu kapsamında da yer alabilir. Bu durumda kişilik hakkının ihlaline ilişkin yaptırımın mı genel işlem koşullarına ilişkin yaptırımların mıuygulanacağı konusu gündeme gelir.
