Doğrudan yabancı yatırımlar bir ülkenin büyümesi, ihracat ve istihdamın artması, teknoloji ve iş tecrübesinin aktarımında önemli rol oynar. Doğrudan yabancı yatırım kararlarında, ev sahibi ülkenin makroekonomik göstergelerinin yanı sıra söz konusu ülkenin mevzuatının yabancı yatırımcıya sağladığı hukuki teşvikler ve korumalar önemli rol oynar. Çalışmada, analiz yöntemi kullanılarak Türkiye’de doğrudan yabancı yatırımlara ilişkin hukuki düzenlemelerin gelişim süreci ve konuya ilişkin Türk mevzuatında sağlanan hukuki teşvik ve korumalar ele alınmaktadır. Türk mevzuatında bu alanı düzenleyen temel düzenleme Doğrudan Yabancı Yatırımlar Kanunu’dur. Kanun doğrudan yabancı yatırımcıya önemli teşvik ve korumalar getirmiştir. Kanun’da yabancı yatırımcının tanım ve kapsamı geniş tutulmuş, zorunlu sermaye miktarı kaldırılmış, izin ve onay sistemi yerine bildirim sistemi getirilmiş, ihtilafların çözümünde tahkime başvuru hakkı tanınmış ve transferler üzerinde herhangi bir kısıtlamaya yer verilmemiştir.
Foreign direct investments play an important role in the growth of a country, and the increase of exports and employment, and the transfer of technology and work experience. In addition to the macroeconomic indicators of a host country, the legal incentives and protections provided are effective to attract foreign direct investments. In this research, developments of Turkish legal regulations on foreign direct investment and legal incentives and protections provided are studied. The basic regulation of Turkish legislation is the Foreign Direct Investment Act. The Act introduced significant incentives and protections to foreign direct investors. The definition and scope of foreign investors were kept broad, the minimum requirement for foreign capital was removed, the notification system was introduced, applying for arbitration in dispute resolution was granted and no restrictions were imposed on transfers.
