İnsani müdahale sorunu uluslararası hukukun son yıllarda en önemli konularından birisidir. Bir tarafta uluslararası hukukun temel prensiplerinden olan kuvvet kullanma yasağı ve devletlerin egemenliği ilkesi, diğer taraftan devletlerin kendi ülkeleri içinde ağır ve sistematik insan hakkı ihlalleri yapması halinde insan haklarını korumak için müdahale gereği, konuya uluslararası hukuka uygun çözüm aranmasına yol açmıştır. Bu makalede insani müdahalenin gerek BM sistemi içinde ve gerekse BM sistemi haricinde hukuku meşruiyeti işlenmektedir. Tarihsel seyir içinde Güvenlik Konseyinin aldığı müdahale kararlarında BMS sözleşmesindeki barış kavramına verdiği anlam ortaya koyulmaktadır.
Humanitarian intervention is one of the most important international law issues in recent years. On the one hand there is one of the basic principles of international law on the prohibition of the use of force and the principle of the sovereignty of states; on the other hand, there is a necessity to intervene in the event of severe and systematic violations of human rights done by states in their own countries. This situation causes to look for an appropriate solution. In this article, legitimacy of humanitarian intervention is dealth with within the framework of both in and outside of the UN system. Meaning of peace according to the United Nations Convention is examined through the decisions that Security Council made.
