Gerek naslar gerek insan doğası ve sosyolojik koşullardaki çeşitlilik, içtihad ehli fakihlerin hukukî birçok mevzuda görüş ayrılığına düşmelerine sebebiyet vermiştir. Söz konusu ayrılık yalnızca fıkıh mezhepleri dâhilinde olmayıp aynı mezhebe müntesip fukahâ içerisinde de vuku bulmuştur. Hanefîlerde de Ebû Hanîfe ve ona tâbî olan imamların fıkhî meselelerde, ekseriyetle görüş ayrılıklarına düştükleri âşikar bir husustur. Fıkıh mezhepleri ve mezhep içerisinde meydana gelen bu görüş ayrılıkları, her ne kadar İslam Âlimlerinin bazıları tarafından rahmet olarak değerlendirilse de İslam hukukunda güvenlik ve istikrar açısından birçok sorunu beraberinde getirmektedir. Dolayısıyla Fukahânın fetva verirken olması muhtemel veya karşılaşılan problemlerin çözümüne kaynaklık etmesi bakımından, mezhep içi tercih yöntemine başvurması elzem bir durumdur. Bu bağlamda herhangi bir fıkhî meselenin hükmüne ulaşabilmek ve mezhep içerisinde müftâbih görüşü saptamak adına muhtasar, şerh ve hâşiye türünden eserler kaleme alınmıştır. Bu çalışmada râcih (kendisiyle fetva verilecek) görüş belirlenirken dikkat edilmesi gereken birtakım usûl kâideleri, konu hakkında yazılan kitaplar , fakihlerin ittifak ve ihtilafları halinde mezhep içerisinde tercih edilen kavlin neye göre belirleneceği, Hanefî mezhebi özelinde irdelenmeye çalışılmıştır.
The diversity of scriptures, human nature and sociological conditions caused the jurists with ijtihad to differ on many legal issues. The separation in question was not only within the sects of fiqh, but also occurred within the fuqaha of the same sect. It is obvious that among the Hanafis, Abu Hanifa and the imams who followed him often disagreed on fiqh issues. Although these differences of opinion within the fiqh sects and sects are considered as mercy by some of the Islamic scholars, they bring along many problems in terms of security and stability in Islamic law. Therefore, it is essential for the fuqaha to resort to the method of preference within the sect in order to be a source for the solution of possible or encountered problems while issuing fatwas. In this context, works such as concise, commentary and annotation have been written in order to reach the verdict of any fiqh issue and to determine the muftabih view within the sect. In this study, some procedural rules that should be considered while determining the preferred opinion (with which a fatwa will be given), the books written on the subject, the way in which the preferred qawl in the sect will be determined in case of alliances and disputes among the jurists, has been tried to be examined in the Hanafi sect.
