Abstract:

HIV/AIDS ile yaşayan bireyler toplumda çeşitli hak ihlallerine maruz kalmaktadır. Tıp etiği ilkelerinden “adalet” ve “özerkliğe saygı” ilkeleri hastalığın doğası gereği HIV/AIDS ile yaşayan bireyler açısından en çok ihlale uğrayan ilkelerdir. Türk mevzuatına göre HIV/AIDS ile yaşayan bireylerin tedavi ve sağlık hizmetlerine hiçbir ayrımcılığa maruz kalmadan, eşit bir şekilde ve damgalanmadan erişebilmesi hakkı; hekimin HIV/AIDS hastasına karşı tedavi ödevi ve tedaviden çekilme hakkı adalet ilkesi kapsamında incelenmiştir. HIV/AIDS ile yaşayan bireylerin aydınlatılmış onam, zorla tedaviye maruz bırakılmama ve tedaviyi red hakkı, özel hayatının gizliliğinin korunmasını isteme hakkı ise özerkliğe saygı ilkesi kapsamında; bu ilke ile ilişkili olan “hekimin ihbar yükümlülüğü”, “cinsel partnerine/eşine bildirim”, “HIV bulaştırmanın cezalandırılabilmesi” konuları da Türk mevzuatına göre değerlendirilmiştir.

Abstract:

While people with HIV benefit from health treatments, they may also experience stigma-based discrimination and other human rights abuses. In terms of medical ethics, actions like compelling people with HIV to take tests and share their information are debated. Other actions include stopping doctors from treating patients who have HIV. Establishing the legal foundation for these activities is crucial for clarifying the rights of people living with HIV. It is also crucial for establishing the parameters for ethical debates on this topic. The legal framework pertaining to the right not to be compelled to medical interventions, the withdrawal of physicians from providing treatment to individuals living with HIV, and the reporting obligation are discussed and examined in this study’s context. The right of individuals living with HIV to access health services without any discrimination while benefiting from health services is also covered.
