Abstract:

In the last few years, the protection system of children in Turkey has been promoted. According to official statistics, the rate of children in need of protection being placed next to the protective family has increased. Parallel to this increase, disputes related to the protective family agency are expected to increase. This study is aimed at assessing the relationship between the child placed with the protective family. In the Turkish law, the original responsibility in the care of the child is the parent and the father who have the right to guarantee. But it is possible for the child to be placed with the family by the judge's decision taking it from the mother and father. The protective family agreement is the agreement that concerns the placement of this child next to the protective family and is signed between the Provincial Directorate of Family, Work and Social Services and the protective family. The child is subject to the "home order" of the protective family by this contract. As a rule, this relationship is protected within the framework of "right to respect the private life" and is protected within the framework of "right to respect the family life". Again, in these exceptional circumstances, the protective family and the child must be regarded as "appropriate" in the legal sense.
