Kişisel veri işleme sözleşmesi, veri işleyenin veri sorumlusunun talimatlarına uygun olarak kişisel verileri işlemeyi taahhüt ettiği; veri sorumlusunun da bu işgörme edimi karşılığında ücret ödeme borcu altına girdiği bir sözleşmedir. Veri sorumlusunun, verilerin işlenmesini sağlamak amacıyla bir gerçek veya tüzel kişiyi yetkilendirmesi ihtiyacı, kişisel veri işleme sözleşmesini gündeme getirmektedir. Bu sözleşme, sözleşme serbestisi ilkesine dayanan ve kanunla düzenlenmemiş bir sözleşme türüdür. Kişisel veri işleme sözleşmesinin esaslı unsurları, kişisel verilerin işlenmesi, bunun karşılığında veri sorumlusu tarafından ücret ödenmesi ve son olarak da sözleşmenin taraflarının anlaşmasıdır. Bu anlaşma herhangi bir geçerlilik şartına tabi kılınmamıştır.
A personal data processing contract is a contract in which the data processor undertakes to process personal data in accordance with the instructions of the data controller; the data controller is also obliged to pay for this processing. The need for the data controller to authorize a real or legal person in order to ensure the processing of the data brings up a personal data processing contract. This contract is a type of contract based on the principle of freedom of contract and not regulated by law. The basic elements of the personal data processing agreement are the processing of personal data, the payment by the data controller in return, and finally the agreement between the parties to the agreement. This agreement is not subject to any validity conditions.
