Abstract:

Although our law includes different institutions aimed at recovery of debtors who have damaged the financial structure, these institutions have not been operated effectively. The financial structure of the bankrupt capital companies and co-operatives has been revoked by the Bankruptcy Delaying Institution No. 7101 and the Law on Amendments to Certain Laws, which is the method applied for the improvement of capital companies and co-operatives. The delay of the bankruptcy removed by Law No. 7101 instead of the institution, the provisions of the concordato contained in the law but not effective have been revived by structural changes. In this work, the concordato was dealt with in the legal and financial aspects, the concordato agency was compared with similar practices, the non-invalid concordato and the process of restructuring the debt of capital companies and cooperatives was thoroughly evaluated along with the concordato project example of a production enterprise.
