Parada sahtecilik suçu TCK m. 197’de kamu güvenine karşı suçlar bölümünde düzenlenmiştir. Kanunkoyucu bu suçu kamu güvenine karşı işlenen suçlar altında düzenleyerek suçla korunan hukukî değerin kişilerin mülkiyet hakkı değil, toplumun tedavüldeki paralara duyduğu güven olduğunu kabul etmiştir. 5237 sayılı TCK’daki suç tipi, 765 sayılı TCK’daki parada sahtecilik suçundan farklı unsurlara sahiptir. Bu farklılıktan hareketle bu suç tipinde özellikle maddî ve manevî unsur bakımından ve nitelikli haller bakımından birtakım değişikliklerin yapılması ihtiyacı bulunmaktadır. Çalışmada hem Türk hem de Alman öğreti ve içtihatlarından faydalanılarak mevcut suç tipinde yapılması gereken değişikliklere ilişkin önerilere, mevcut düzenlemenin yorumlanmasına ve uygulamadaki sorunlu noktaların çözümüne ilişkin değerlendirmelere yer verilmiştir.
The crime of money fraud was committed by the TCK in 197 against public confidence. The lawmaker acknowledged that the legal value protected by the crime by organizing this crime under the crimes committed against public confidence is not the right of ownership of persons, but the confidence that the society feels in the money in treatment. The type of crime in the TCK No. 5237 has different elements than the crime of fraud in the TCK No. 765 . With this difference, there is a need to make a number of changes in this type of crime, especially in terms of material and spiritual elements and in terms of quality conditions. The study included recommendations on the changes to the current type of crime, taking advantage of both Turkish and German teachings and teachings, assessments on the interpretation of the current regulation and the solution of the problematic points in the practice.
