Abstract:

When a crime which can be committed by a single individual is committed by more than one individual, it refers to the act of participation to crime. Being one of the most important topics in the Criminal Law, different states make reference to different regulations with regards to the participation to crime. Significant differences also exist between the Turkish and Russian Criminal Law with respect to the issue of participation. For instance, in terms of the Turkish Criminal Law, the responsibility for the participation to crime depends at least on the existence of a stage characterized with an attempt to crime whereas for the Russian Criminal Law, the stage characterized by preparatory acts to the eventual commission of crime is satisfactory for the responsibility with the participation. Turkish Penal Code does not prescribe an aggravation of general punishment for crimes committed with participation. On the other hand, Russian Penal Code prescribes participation to crime as a reason for the aggravation of general punishment. This study analyzes the issue of participation in Russian Federation’s Penal Code under the titles as follows: systems about the legal characteristics of crime and punishment, historical development of participation to crime, conditions for participation, types of participation to crime, punishment for participation, participation to the crimes of special status of the subject/perpetrator, intemperance of the perpetrator, voluntary abandonment from crimes committed with participation. Since the study aims the Turkish readers, provisions in the Penal Codes of Russian Federation and Turkey will be compared with reference to participation.
